Anna Maria Life Vacation Rentals Terms & Conditions

Thank you for booking your upcoming stay with Anna Maria Life Vacation Rentals (AMLVR). We are excited to have you stay with us. It is our intent to be here to assist you and help make your vacation amazing. The following are our Terms & Conditions and are in place to ensure our homes are ready for you while providing a safe and enjoyable experience. Paying the initial payment is an acceptance of these Terms & Conditions. It is extremely important you read and understand all of the Terms & Conditions. Non-compliance with these rules could result in termination of your booking without refund. These Terms and Conditions are subject to modification.

1. Payments
A. At the time of reservation, an initial payment equal to 25% of the base rental rate is due. The Guest is required to place a credit card on file at the time of booking to secure the reservation. AMLVR accepts VISA, MasterCard, and Discover. Reservations made within 60 days of arrival require payment made in full at the time of reservation.

B. The balance of Rent and all fees are due 60 days PRIOR TO arrival. For your convenience, AMLVR WILL AUTO-CHARGE THE BALANCE TO YOUR CREDIT CARD ON FILE. In the event that your credit card on file is declined when Auto-Charged, you will be contacted by an AMLVR Agent for a substitute payment method. You will be subject to the INSIDE of 60 DAYS TO ARRIVAL provision of our Cancellation Policy if a payment cannot be made at that time. Other forms of accepted payment are check, e-check, money order, and debit card. Checks and money orders should be made payable to Anna Maria Life Vacation Rentals. Wire Transfers are accepted with a charge of $50.00 per wire. 2. Cancellation Policy
Please notify AMLVR as soon as possible with the need to cancel. The sooner we are advised of your need to cancel your reservation, the better we can assist. All cancellations must be received in writing. Please email any cancellation request to info@annamarialifevacationrentals.com. Cancellation requests must include the guests name, confirmation number, and dates of stay.

A: OUTSIDE OF 60 DAYS TO ARRIVAL: Guest will be refunded all monies paid minus a $249 Cancellation Fee, Admin Fee, and any paid Travel Insurance Premiums. Refunds will only be made to the original payment method. If the original payment method is unavailable, we will issue a check to the party listed on the reservation.

B: INSIDE OF 60 DAYS TO ARRIVAL: Refunds are subject to AMLVR’s ability to re-rent the Property for the originally agreed upon rate. AMLVR will issue a refund in the amount we were able to re-rent the property minus the $249 Cancellation Fee, the Admin Fee, and any paid Travel Insurance Premiums. If the property is re-rented for less than the originally agreed upon amount, the guest will not be refunded the difference. AMLVR does not make any sort of guarantee that we will be able to re-rent the property or re-rent the property for the originally agreed upon rate. No refunds will be issued for non-arrival, late arrival, early departure, or changes to the reservation. AMLVR strongly recommends Travel Insurance to cover unforeseen circumstances.

3. Travel Insurance
AMLVR is proud to offer travel insurance through Generali Global Assistance (GGA) which can be added at the time of reservation. The travel insurance plan is effective the day payment is received. Travel insurance is strongly recommended to help protect the guests’ vacation investment in the case of unexpected circumstances. The Plan includes coverage for the loss of prepaid, non-refundable trip costs if the trip is unused or interrupted due to certain unforeseeable events. Outstanding reservation costs are not eligible for reimbursement at the time of cancellation and the cost of the Plan is not eligible for a full refund outside of the Plan’s free look period. Terms and conditions apply; please read your Plan documents carefully. Questions concerning travel insurance should be directed to GGA at 800-999-4018 or on GGA’s website at www.vacationrentalinsurance.com.

4. Fees
A. Administrative Fee: A non-refundable Administrative Fee is added to each reservation.

B. Cleaning Fee: All AMLVR rental properties are cleaned to quality standards. The cleaning fee is based on the property’s size and amenities and is automatically included in the reservation at the time of booking. The cleaning fee is non-negotiable. During their stay, the Guest is responsible for maintaining the cleanliness of the property. Daily housekeeping is not included in the Rental Agreement; however, AMLVR can assist in arrangement of the service, upon the Guest’s request. The Guest is responsible for all fees associated with the daily housekeeping service and must submit payment at the time of scheduling. Upon the Guest’s departure, if the property is left in a condition that requires excessive cleaning, an additional fee will be charged to the Guest’s credit card on file for a minimum of $100 and or up to the total amount needed to restore the property to its original condition.

C. Linen Fee: A linen fee, based on the property’s size, is automatically included in the reservation at the time of booking All AMLVR rental properties are furnished with an appropriate amount of high-quality linens and towels. The linen fee is non-negotiable. Prior to check-in, AMLVR completes an inventory of linens and towels. Upon check-out, AMLVR will also complete an inventory. In the event of a discrepancy, an additional fee will be charged to the Guest’s credit card on file. The amount charged will be determined by the missing amount of missing linens.

D. Security Deposit Waiver: A Non-Refundable Security Deposit Waiver (SDW) fee is automatically included in the reservation at the time of booking. If during the Guest’s stay, any damage to real or personal property of a unit as a result of inadvertent acts or omissions, the guest will be held responsible for the cost of replacing and/or fixing damages. AMLVR reserves the right to charge the card on file in the total amount needed to restore the property to its original condition. If the Guest does not wish to pay the SDW, a refundable security deposit can be requested. See details below.

E. Security Deposit: If the Guest chooses to opt out of the non-refundable SDW, a refundable $1500 Security Deposit can be added by request to the Guest’s Rental Agreement. The security deposit will be due 60 days prior to the Guest’s arrival date. AMLVR reserves the right to withhold any or all of the security deposit for a period of up to 14 days after the Guest’s departure date to allow for inspection of the rental property. Under this option, if during the Guest’s stay, a person causes any damage or to real personal property of a unit as a result of inadvertent acts or omissions, the Security Deposit will be used to cover the cost of repair or replacement of such property and any remaining monies will be refunded to the Guest within 21 days. If damages exceed the amount paid for the Security Deposit, the Guest’s credit card on file will be charged to cover the full cost of repair or replacement and no refund will be issued.

F. Taxes: Vacation rental properties are subject to Florida’s state and local resort tax.

5. Check-In & Check-Out
A. Check-In/Arrival for all AMLVR homes is 4pm on the date included in the Rental Agreement. Accessing the property; including the home, pool, and driveway, prior to approved check in time, is prohibited. Leaving personal items at the property, including but not limited to luggage, groceries, and vehicles is prohibited. To assure the home is ready for the next arrival, there are many steps that must take place. Please understand, this is necessary to ensure the home is cleaned, maintained and properly inspected. AMLVR tracks the progress of these steps and will notify the guest if the home is ready for an early arrival. Thank you for your patience and understanding in this matter. Detailed arrival and entry instructions will be noted in the guest reservation information.

B. Check-Out/Departure for all AMLVR homes is 10am on the date included in the Rental Agreement. The 10am departure is necessary to ensure there is ample time for the home to be cleaned, maintained and properly inspected. The guest is subject to a fee up to $500 if they fail to depart by the designated time of 10am. This fee will be charged to the guest’s credit card on file.

6. Acts of God, Inclement Weather, Pandemics
Neither AMLVR nor the Property Owner will be held responsible, liable, or issue refunds for situations beyond their control including but not limited to hurricanes, red tide, pandemics, public health issues, beach and/or road closures, fire, lightning strikes, or tornadoes. AMLVR strongly advises purchasing travel insurance to protect your vacation investment. Please read the policy carefully to confirm it provides the appropriate coverage. If a claim filed with the travel insurance company is denied, AMLVR is not responsible for any refunds or credits.

7. Hurricanes
Should a hurricane or tropical storm threaten the area, the National Hurricane Center and local governing officials will announce evacuation procedures if needed.

A. In the event of a voluntary evacuation (the guest decides to leave on their own accord), neither AMLVR nor the Property Owner is required to provide a refund or credit.

B. In the event a mandatory evacuation order is given by local officials, refunds and or credits are not the responsibility of AMLVR or the Property Owner. AMLVR strongly advises purchasing travel insurance to protect your vacation investment. Please read the policy carefully to confirm it provides the appropriate coverage. If a claim filed with the travel insurance company is denied, AMLVR is not responsible for any refunds or credits.

C. In the event of a mandatory evacuation order given by local officials, all members of the guests’ party must evacuate the premises by the specified time.

8. Occupancy
A. The individual entering into the rental agreement must be at least 25 years of age and must occupy the property the full length of the rental term. Guests who violate this policy are subject to immediate eviction and forfeit all rental payments.

B. Please remember that AMLVR must adhere to all city ordinances, which include occupancy limits. All AMLVR rental properties have different maximum occupancy limits based on city regulation. Large gatherings, parties, weddings and receptions or other events are strictly prohibited. If the occupancy exceeds the property’s limitations it will result in immediate eviction without refund and loss of all monies collected, including all fees and taxes.

C. The guests shall comply with all applicable laws and governing homeowners, and/or condominium associations, and promptly comply with governmental order or directive for the correction or prevention of any violation of applicable law in connection with the guests stay at the property.

9. Minimum Age
All AMLVR homes require the home to be booked by a person 25 years of age or older. The person who rented the home and whose name appears on the rental agreement must be present on the day of arrival and must stay in the property for the duration of the booking. If proof of age is requested by AMLVR for any reason, the person who rented the home and whose name appears on the rental agreement agrees to show proof of age to an AMLVR representative. All persons staying at the property under 25 years of age must be accompanied by a legal guardian or parent. AMLVR reserves the right to terminate any reservation that does not follow this requirement. This will result in the loss of any and all monies collected as well as immediate evacuation of the home.

10. Smoking
All AMLVR rental properties are smoke-free. Smoking is not permitted inside the home, on balconies, patios, in the pool or spa, or anywhere within the property lines. Failure to comply will result in a $500 fee or up to the total amount needed to restore the property to its original smoke-free condition. AMLVR reserves the right to charge the card on file for said violation.

11. Dogs
Some AMLVR rental properties are dog-friendly and designated as such on the individual property’s webpage. If the Guest reserves a dog-friendly property, and plans to bring a dog, AMLVR must be notified at the time of reservation and a non-refundable $150 plus tax per dog fee will be applied to the reservation. Any guest who brings a dog to a dog-friendly home but fails to notify AMLVR in advance of arrival and/or fails to pay the dog fee will be charged a non-notice dog fee of $250.00. If the Guest has a dog in a non-dog-friendly property, the Guest will need to vacate the rental property immediately and forfeit all previous payments for that particular stay. In this situation, AMLVR will attempt to relocate the Guest to a dog-friendly property, if available. The Guest will be responsible for all costs incurred resulting from the relocation, including rent, fees, taxes and returning the property to its original condition. If a guest brings a dog into a non-dog friendly home and it does not come to AMLVR’s attention until after the guest leaves, there will be a non-notice dog fee charged to the card on file for a minimum of $300 or up to the total amount needed to restore the property to its original condition. AMLVR reserves the right to charge the card on file for said violation.

Noncompliance with the policies outlined above will result in a minimum of a $300 fee or up to the total amount needed to restore the property to its original condition. Dogs are not allowed in the pool, spa, or on any furniture including beds. Any waste left by the dog must be picked up and properly disposed of prior to departure. AMLVR reserves the right to charge the card on file for said violation.

12. Pools, Spas & Pool Features
A. Pools are professionally serviced once or twice per week by licensed and insured technicians with a varied schedule. Please note, pool service technicians will have access to the backyard and pool area and may not always be heard nor are they required to announce themselves.

B. AMLVR is not responsible for pool, spa, or pool feature malfunctions, but will do everything possible to make sure all are maintained and working properly. No credit, discount, and/or rate adjustment will be granted for pool, spa, or pool feature malfunctions, or for circumstances beyond AMLVR’s control.

C. If the ambient temperature falls below 60 degrees F the pool heater may not function as normal and may even switch off to prevent damage to the unit.

D. Because there are no lifeguards, monitors, or other attendants at the pool, spa, or pool features, the Guest is expressly responsible for their own safety, as well as family members and guests, while using the pool, spa, pool features or other recreation facilities and in so using or permitting to be used, specifically waives any and all liability claims, expressed or implied, against AMLVR, Property Owner, or the Condominium/Homeowners Association. No Guest shall permit any juvenile to play in or around any pool, spa, pool features or other recreation facilities without providing an attendant who is able to protect such juvenile in case of difficulty in or around the water. Guests are specifically prohibited from playing on or around or allowing their families or guests to play on or around, decorative rock or water features that may be associated with pool/patio areas, as such features are not designed for such use and may be dangerous or unstable.

E. Any guest accessible pool feature controlled by a remote will be clearly marked if applicable. A guest is strictly prohibited to tamper with any pool or spa equipment settings, controls, or valves. Doing so will cause damage to the pool and or spa equipment and guests will be charged accordingly for any resulting repairs or service calls.

F. AMLVR is required by Florida state law to install and maintain alarms on every window and door that lead directly to the pool. These alarms are a safety precaution and must not be disabled or damaged by the guest. AMLVR cannot and will not disable the alarm. In the event the alarm does not sound, the guest is required to notify AMLVR so it can be repaired or replaced as needed. The bypass button allows the guest approximately 10 seconds to exit or enter before the alarm will sound. In the event the bypass button is damaged, the guest must contact AMLVR so it can be repaired or replaced as needed.

13. Parking
Most AMLVR rental properties have limited parking spaces available. The number of appropriate spaces is specified in the home’s listing. Therefore, recreational vehicles (RVs), boats, motor homes, trucks, trailers, etc. are not permitted without prior written approval by AMLVR. AMLVR will not be held responsible or expected to pay for any parking citations that a guest may receive by the city.

14. Amenities
A. AMLVR properties are individually owned and therefore reflect the taste of each private owner. Amenities will vary from property to property and may also change from time to time. AMLVR will not be responsible for providing additional furnishings of equipment and will not be liable for any changes and/or errors provided in amenities listed on AMLVR or any third-party marketing websites.

B. All AMLVR homes are supplied with a basic amenities such as soaps and paper goods as a starter package. The guest should plan to purchase additional supplies at local convenience and grocery stores.

C. AMLVR requires any and all beach toys and or equipment included with the home are to only be used for their intended use. Any of these items must be returned to the home prior to departure. Any lost, stolen or damaged items are the responsibility of the guest and may result in being charged to the card on file. These items include, but not limited to: beach chairs, kayaks, stand up paddle boards, bikes and toys. Any of these advertised items are subject to change. If these items are damaged at any time, the owner may elect not to replace them and is not the responsibility of the homeowner nor AMLVR to replace or provide for your stay.

15. Trash & Recycling
A. Trash Pick Up: GREEN BIN is for trash only. All trash must be deposited in these green bins. Please check the Informational Home Binder for scheduled pick up dates. AMLVR homes are scheduled for designated pickup locations so it is important to leave the trash bins where you found them to ensure they will be picked up. Please be sure to leave a very clear path to the trash bins on the day of pickup to ensure Waste management companies can see and access the bins. If they cannot see the bins or have easy access to the bins, they will not be emptied and the trash will not be picked up. This is also important to make sure to comply with city and county ordinances.

B. Recycling Pick up: BLUE BIN is for recycling ONLY. All recycling must be deposited in these BLUE bins. Please check the Informational Home Binder for appropriate pickup dates. AMLVR homes are scheduled for designated pickup locations so it is important to leave the Recycle bins where you found them to ensure they will be picked up. Please be sure to leave a very clear path to the Recycle bins on the day of pickup to ensure Waste management companies can see and access the bins. IF they cannot see the bins or have easy access to the bins, they will not pick up the recycling and bins will not be emptied. This is also important to make sure to comply with city and county ordinances. PLEASE be sure to separate trash from Recycling. PLEASE do not bag up Recycle materials in the Recycle bin. Mixing and/or bagging of materials may lead to the bins not to be picked up.

16. Internet Service
All AMLVR rental properties offer wireless high-speed internet service. However, due to various personal computer configurations, AMLVR can only guarantee that the service is available from the provider. AMLVR does not have the expertise to configure computers to accommodate the service. AMLVR will do its best to assist the Guest, but will not be held responsible, or issue a refund, if the Guest is unable to use the service due to lack of ability to connect to the guest’s devices.

17. Keys and Remotes
If the home requires keys, remote controls, or fobs, the guest is responsible for leaving any and all of these items at the home upon departure. If any of these items are unaccounted for, a minimum fee of $100 per item will be charged to the guest’s credit card on file. This fee is subject to change.

18. Maintenance
A. The Guest must notify AMLVR of any maintenance request or deficiency as soon as identified. AMLVR will expedite repairs as quickly as possible. Some requests may require outside vendors to repair and/or replace equipment. If an outside vendor finds the equipment is not working due to Guest misuse, oversight, or negligence, the Guest will be responsible for incurred service charges. No rent adjustments will be made for circumstances beyond AMLVR control for malfunction or loss of use of equipment or amenities. The Guest agrees to allow AMLVR employees, vendors, contractors, or subcontractor’s access to the rental property to make necessary repairs or improvements if AMLVR deems it necessary to enter the property in order to keep the guest and or the home safe.

B. In the event of a previously identified maintenance issue, it may be necessary for AMLVR to allow our technicians or third-party vendors into the home. We will do our best to provide information and notification to the guest. No rent adjustments will be made for circumstances beyond AMLVR control or for malfunction or loss of use of equipment or amenities. The Guest agrees to allow AMLVR employees, vendors, contractors, or subcontractor’s access to the rental property to make necessary repairs or improvements.

C. AMLVR homes have several regularly scheduled maintenance requirements throughout the year. AMLVR will do our best to limit guest interruption and to notify the guest of the scheduled task.

19. Telephone & Pay Per View Charges
In all AMLVR rental properties equipped with a telephone, local calls are free of charge. Depending on the Property Owner’s telephone plan, free long distance may be available. Most of AMLVR homes have disabled the ability to purchase any pay-per-view movies or shows. However, if a guest does purchase any type of programming, the guest is responsible for that payment. AMLVR reserves the right to charge a guest’s credit card on file appropriately if there are any charges for such items on the owner of the home’s cable bill that were incurred during the guests stay.

20. Furniture & Accessories
AMLVR requires all guests to leave the home as it was found. Furniture and accessories are not to be moved or removed from the property. All bedding, blankets, pillows, and accessories must stay in the home and returned to the original location it was found.

21. Rental Rates & Website Modifications
AMLVR rental rates fluctuate daily and are subject to change. Until a reservation is booked and an initial payment has been paid, rates are not guaranteed and are subject to change without notice. All information on rental listings and information listed in any publications are deemed accurate, however, items, amenities and decor can change occasionally without notice. AMLVR will do our best to inform guests of changes, however, is not responsible for changes or omissions made by the homeowner.

22. Firearms
Firearms are prohibited on all AMLVR properties. Guest acknowledges that any firearm found, or left on property, will be reported immediately to local law enforcement. AMLVR is not responsible for returning the firearm to the guest.

23. Noise Ordinance
AMLVR properties are located in a residential area. Please be a good neighbor by keeping the noise to a respectful level during the day and night. Excessive and unreasonable noise can deprive neighbors of the peaceful enjoyment of their private property. Anna Maria Island has a noise ordinance that is enforced by local law and by code enforcement officers which is in effect from 10pm to 7am. Please be mindful of the noise level, music, and pool activities during this time frame. Failure to adhere to the zero-tolerance noise ordinance could result in fines and immediate eviction.

24. Construction
When the local authorities or property owners engage in construction to their properties and/or the land they own, they are not required to notify any vacation rental company of construction plans. They are required to only work within certain hours; typically, 7am – 5pm. This does fluctuate depending on the ordinance rules of your location. In the event construction should occur in the proximity of the Guest’s rental property before or after a reservation is confirmed and/or during the Guest’s stay, AMLVR cannot be held responsible for any inconvenience this may pose. All such activity is governed by ordinances of the island municipalities and strictly enforced.

25. Infectious Disease
Each rental property is cleaned before the Guest arrives. However, AMLVR and the Property Owner cannot guarantee that infectious viruses and diseases will be completely eliminated by cleaning, or that infectious diseases and viruses are not brought to the property during the Guest’s occupancy. The Guest agrees that neither AMLVR nor the Property Owner are responsible for any infectious diseases or viruses contracted during the Guest’s occupancy, and the Guest agrees to hold AMLVR and the Property Owner harmless from any loss, damage, or injury suffered by the Guest as a result of an infectious disease or virus which may be contracted while the Guest is staying in the property.

26. Government Closure
Certain circumstances may arise where the local, state, or federal government limits, prohibits, or restricts occupancy of the rental property. Any such governmental restrictions cannot be anticipated or controlled by AMLVR or the Property Owner, and AMLVR and the Property Owner shall not be responsible for any loss or damage incurred by a Guest as a result of such governmental action. Depending on the circumstances surrounding the governmental action, AMLVR may offer the Guest an opportunity to reschedule their visit to the rental property, if it is available, or another similar rental property. If the Guest elects to reschedule their visit, the rental rate will be adjusted to the greater of the rate agreed to by the Guest for the cancelled stay or the rate for the rental property for the rescheduled dates. If the Guest’s stay is not rescheduled, the will forfeit all monies paid.

27. Items Left On-Site
Neither AMLVR, the Property Owner, nor the housekeepers will be held responsible for items left in a rental property. If AMLVR or the Property Owner is requested to retrieve and mail items left on-site, the Guest will be responsible for any incurred fees including shipping charges. Inquiries must be made within 30 days after departure date.

28. Phone Recordings
All incoming and outgoing phone calls to AMLVR are recorded for quality assurance, training and accuracy. Guest acknowledges that they are aware and consent to their call being recorded.

29. Text Messaging
AMLVR uses Text Messaging as a means of Guest communication for matters relating to pre and post arrival, payment reminders, and emergencies and weather. AMLVR will not share your information with any 3rd party nor will they share your information for any other marketing purposes outside of our company.

30. Substitution of Accommodations
Should unforeseen circumstances arise beyond AMLVR’s control, AMLVR reserves the right to substitute the property. If a similar property is not available, all monies paid will be refunded.

31. Properties for Sale
If a reserved rental property is for sale, it may be necessary for AMLVR or a licensed real estate agent to show the property during the Guest’s occupancy. In this case, the Guest will agree to showings. AMLVR will provide 24-hour notice to the guest when a showing is scheduled. Be assured, AMLVR will make every attempt to schedule a showing at a time that is convenient for the Guest.

32. First Right of Refusal
The Guest reserving a property for 28 days or more has a first right of refusal on the property they are currently renting for the following year. The Guest is fully responsible for notifying AMLVR of their desire to reserve the same property within five (5) days of their current arrival. However, AMLVR has no control over any owner bookings that may interfere with a first right of refusal.

33. Fines and Penalties
Guests will be responsible for any and all fines, penalties, or citations assessed by the municipalities or condo associations, either at the time of incident or after departure, to them individually, to the Property, or to AMLVR during their dates of occupancy including, but not limited to noise, parking, or trash.

34. Indemnity
The Guest indemnifies AMLVR and the Property Owner from and against any and all liability, loss damage and expense, including reasonable attorney fees and disbursements arising from injury to persons or damage to rental property; occasioned by the failure of the Guest to comply with any provision of law or this agreement; occasioned by any willful act of omission of the Guest or any person residing in or renting Owner’s property; with the exception of such acts or commissions constituting negligence or willful misconduct of AMLVR, its agents, servants, or contractors when acting as agent for the Property Owners as provided herein. Special risks may be involved when using pools, spas, or pool features and the Guest assumes all responsibility for themselves and their guests and for the consequences of those at risk. The Guest agrees to waive any claim whatsoever and hold harmless AMLVR and the Property Owner for accidents and claims resulting from accidents and or injury arising from use of the rental property and any of its equipment, porches, decks, stairs, parking area, elevators, common area, pool, spas, pool features, etc. The Guest agrees to reimburse the Property Owner for any fine or penalty which may be imposed upon the Property Owner by any court or by the Condominium/Homeowners Association, and municipality by reason of any violation upon the premises through the use thereof, or fault of the Guest herein, their agents or servants.

35. Radon Gas
Radon gas is a naturally occurring radioactive gas that, when accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels that exceed Federal and State guidelines have been found in buildings in Florida. Additional information regarding Radon Gas and Radon testing may be obtained from the Manatee County Health Unit http://www.doh.state.fl.us/chdmanatee.

36. Agency Disclosure
Pursuant to Florida Statutes Chapter 475, the Guest is hereby notified that in connection with the property rented by this firm, AMLVR, the Agent for the Property Owner, is being compensated as such by the Property Owner. The Guest acknowledges that this written notice was given and is understood, prior to signing a Rental Agreement, in compliance with all applicable Florida Statutes.

37. Disputes & Damages
AMLVR takes many strides to ensure the home is free of damage and/or issues with items in the home, however, we do understand things may happen. If items are found to not work properly or there are damages in the home or dissatisfactions, Guest agrees to notify AMLVR immediately during their stay. AMLVR needs to be notified immediately so we can do our very best to rectify the problems if any. Disputes brought to AMLVR’s attention after a guest departs does not give us the opportunity to remedy these issues and may result in no compensation accordingly. In the event of a guest charge back, AMLVR reserves the right to provide any and all phone recordings, written documentation from emails and internal communication including photographs to the credit card company pertaining to the matter.

38. Accidents, Injury, Loss
A. All AMLVR guests shall indemnify, defend, and hold harmless Anna Maria Life Vacation Rentals and the owner(s) of the property from any and against all liabilities, claims, expenses, fees, less of use of actions arising out of Guests or their guest’s use and occupancy of the premises or use of equipment located in or on the property. Guests assume all responsibility for themselves and their guests.

B. The guest understands and accepts that any equipment located in or on the property or supplied by Anna Maria Life Vacation Rentals is provided without any warranty about this condition or suitability.

39. Assumption of Risk
AMLVR guests understand if a guest is injured or harmed or causes injury or harm to other persons or property associated with their stay, AMLVR may not get held responsible. The guest understands this is a residential property, and if the home has a pool or spa/hot tub, the pool or spa/hot tub creates an inherently dangerous environment due to the potential for jumping, climbing, and swimming in the pool or spa/hot tub and possible drowning. Using other recreational items or features at the property, such as kayaks, rafts, rooftop decks, water access, paddle board, bikes and pool water features such as water slides or pool waterfalls, is inherently dangerous because of their potential for falling off, drowning, or other injury Guest hereby assumes all risk for the use of the property and items supplied at our around the property that may harm, injury or any loss that may occur to Guest or Guest’s property. The guest also RELEASES Anna Maria Life Vacation Rentals and the owner(s) of the property from all claims, liability, causes of action, and demands that arise in any way from any personal property damage, injury, death, loss or harm that occurs to Guest or any other person or to any property as a result of Guest’s use of any of the equipment at the property.
